Terms of Service

1. Scope

These Terms of Service (ToS) apply to the use of the Artist4Friends platform (hereinafter "Platform" or "Service"), operated by BotExplode UG (haftungsbeschränkt), Kleinstückenweg 7i, 15806 Zossen, Germany, Managing Director: Paul Rybka (hereinafter "Provider").

By registering and using the Platform, you accept these ToS. Deviating terms of the user are not recognized unless the Provider expressly agrees to their validity in writing.

2. Service Description

Artist4Friends is a platform for artists and DJs to manage:

  • Events and shows
  • Guest lists and registrations
  • Digital tickets

2.1 Free Usage

The free version includes:

  • Creation and management of up to 3 events
  • Up to 50 guests per event
  • Basic guest list features

2.2 Pro Subscription

The Pro subscription additionally includes:

  • Unlimited events
  • Unlimited guests per event
  • Digital tickets with QR codes
  • Export functions (CSV)
  • Advanced statistics

3. Registration and Account

Registration is required to use the Platform. You agree to:

  • Provide truthful information during registration
  • Keep your login credentials confidential
  • Immediately inform the Provider if you suspect misuse
  • Not transfer your account to third parties

The Provider reserves the right to suspend or delete accounts for violations of these ToS or abusive use.

4. Payment Terms

4.1 Prices

Current prices for the Pro subscription are displayed on the Platform. All prices include applicable VAT.

4.2 Payment Processing

Payment processing is handled by Stripe. Stripe's terms of service also apply.

4.3 Subscription Duration

  • Monthly: The subscription automatically renews for one month unless canceled before expiration.
  • Annually: The subscription automatically renews for one year unless canceled before expiration.

4.4 Cancellation

Cancellation is possible at any time effective at the end of the current billing period. After cancellation, Pro access remains active until the end of the paid period. Already paid amounts are not refunded.

5. Right of Withdrawal

As a consumer, you have a 14-day right of withdrawal. The withdrawal can be made in writing (e.g., by email) to hey@artist4friends.com.

The right of withdrawal expires prematurely if you have expressly agreed that we begin performing the contract before the withdrawal period has expired and you have confirmed your knowledge that you lose your right of withdrawal by consenting to the start of contract performance.

6. User Obligations

The user agrees to:

  • Use the Platform only for legal purposes
  • Not post illegal, offensive, or pornographic content
  • Respect the rights of third parties (especially copyrights)
  • Not technically attack or manipulate the Platform
  • Not perform automated queries without permission

7. Liability

7.1 Limitation of Liability

The Provider is fully liable for intent and gross negligence as well as for injury to life, body, or health. In case of slight negligence, the Provider is only liable for breach of essential contractual obligations, limited to foreseeable, contract-typical damage.

7.2 Availability

The Provider strives for high availability of the Platform but does not guarantee uninterrupted accessibility. Maintenance work will be announced when possible.

7.3 Data Loss

The Provider performs regular backups but does not guarantee complete data recovery. Users are responsible for their own backups.

8. Referral Program

The referral program allows users to earn bonus months by referring new Pro users.

  • For each referred user who subscribes to Pro, the referrer receives one free month.
  • The referred user also receives one free month when subscribing to Pro.
  • The Provider reserves the right to modify or terminate the program at any time.
  • Abuse (e.g., self-referrals, fake accounts) results in exclusion from the program.

9. Changes to Terms

The Provider reserves the right to change these ToS. Changes will be communicated to users by email. If the user does not object within 30 days of receiving the notification, the new ToS are considered accepted.

10. Final Provisions

The law of the Federal Republic of Germany applies, excluding the UN Sales Convention. The place of jurisdiction is, as far as legally permissible, the Provider's place of business.

Should individual provisions of these ToS be invalid, the validity of the remaining provisions remains unaffected.
